These terms are an agreement between you and Cypress Technologies LLC ("we", "us"), which runs canvasletter at canvasletter.com. They cover the website, the app, published pages and everything else we provide (the "service"). By creating an account or using the service, you agree to them. If you use canvasletter for an organization, you agree on its behalf and confirm you're allowed to.

Your account

  • You must be at least 16, and old enough to form a binding contract where you live.
  • Give us accurate details and keep your password safe. You're responsible for what happens in your account and your workspaces.
  • Workspace owners and admins control their workspace: who's a member, its plan and its content. If you're invited to someone else's workspace, its owner decides what happens to the content you create there.
  • Tell us straight away at support@canvasletter.com if you think someone else has access to your account.

Your content

  • You own your content: the notes and drafts you give us, the issues designed from them, your brand kits and the images you upload.
  • You give us permission to use it to run the service. That means storing, copying, rendering, exporting and displaying it as needed to provide canvasletter to you, including sending it to our service providers (such as our AI provider) for that purpose. The permission ends when you delete the content, except for copies kept in backups for a limited time and published images that sent emails still use.
  • We don't use your content to train AI models.
  • You're responsible for your content. Make sure you have the rights to what you upload and publish: text, images, logos and fonts. Images from Unsplash come under the Unsplash license, and canvasletter credits the photographer.
  • Published pages and images are public to anyone with their link.

AI features

canvasletter uses AI to design and edit issues from your words. AI output can be wrong, incomplete or similar to output for other users. Read what it produces before you send it. You're responsible for checking facts, figures, links and anything you publish. The AI never sends, exports or publishes anything; only you can.

Acceptable use

Don't use canvasletter, or pages published with it, to:

  • phish, or collect passwords or payment details under false pretenses,
  • spread malware or harmful code,
  • impersonate a person, brand or organization you don't represent,
  • run scams, or make deceptive financial or health claims,
  • share sexual content involving minors or intimate images shared without consent,
  • harass, threaten or dox anyone, or promote violence or hate,
  • publish anything illegal, or that infringes someone else's rights,
  • build landing pages for spam or unsolicited bulk email,
  • break, overload or probe the service, get around its limits or access other workspaces, or
  • copy the service, resell it or scrape it with automated tools.

You're responsible for following the email laws that apply to what you send (such as CAN-SPAM, CASL, PECR and GDPR), including consent and unsubscribe rules. Your email platform sends your newsletter, not us.

If you see a page that breaks these rules, report it. We may remove content, restrict features or suspend accounts that break these terms, and we'll tell you why. You can appeal by replying to that message.

Plans, payment and AI credits

  • The Free plan costs nothing. Paid plans and their prices are on our pricing page.
  • Paid plans are billed in advance through Stripe, monthly or yearly, and renew automatically until you cancel. You can cancel at any time, and you keep your plan until the end of the period you paid for.
  • Payments aren't refundable, except where the law requires it.
  • We may change prices. If a change affects your plan, we'll tell you at least 30 days before it applies to your next renewal.
  • AI credits pay for AI actions. Each plan includes a monthly allowance. Credits have no cash value, can't be transferred and are used only within canvasletter. If an AI action fails, its credits are returned.
  • When you downgrade, your work stays; features above your new plan's limits become read-only.
  • Free plan pages and exports may show a small "Made with canvasletter" line.

Third-party services

canvasletter works with services we don't control, such as your email platform, Google sign-in and Unsplash. Your use of them follows their terms. We aren't responsible for them, and we can't guarantee that an export or a push will look the same in every email client or platform.

Our service

  • canvasletter, its design, code, templates and brand are ours. These terms don't give you any rights to them beyond using the service.
  • If you send us feedback or ideas, we may use them without any obligation to you.
  • We keep improving canvasletter, so features may change. If we remove something important you pay for, we'll tell you in advance.

Ending the agreement

You can stop using canvasletter and delete your account at any time. We may suspend or end your access if you break these terms or if we have to by law. If we ever close canvasletter, we'll give you at least 30 days' notice and a way to export your issues.

Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the service will be uninterrupted or error-free, or that AI output will be accurate.

Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars. Some places don't allow these limits, so they may not all apply to you.

Indemnity

If someone makes a claim against us because of your content or your breach of these terms, you'll cover our reasonable costs and losses from that claim.

Governing law and disputes

These terms are governed by the laws of the United States and of the state where Cypress Technologies LLC is organized, without regard to conflict-of-law rules. Disputes go to the state and federal courts of that state, and both sides agree to their jurisdiction. If you're a consumer in a country whose laws give you the right to bring claims in your own courts, these terms don't take that right away. Before going to court, please write to us; most problems can be solved by email.

Changes to these terms

When we change these terms, we update the date at the top. If a change is significant, we'll tell you by email or in the app at least 14 days before it takes effect. If you keep using canvasletter after that, the new terms apply.

General

These terms, with our privacy policy and cookie policy, are the whole agreement between us about the service. If a part of them can't be enforced, the rest still applies. If we don't enforce a part straight away, we haven't given up the right to. You can't transfer these terms without our consent; we may transfer them as part of a merger or sale.
